Vanda's Club Loyalty Card Terms and Conditions

Definitions

Capitalized terms used in these regulations have the following meanings:

  • Issuer – Vanda Novak spółka z ograniczoną odpowiedzialnością, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000712700, NIP: 6751632399, REGON: 369217883, with its registered office in Kraków (31-511), ul. Rakowicka 11, with the share capital of PLN 10,950 paid in full;
  • Stationary shop or boutique – a point of sale of goods run by the exhibitor located at the following address: Warsaw, ul. Mokotowska 51/53, 00-542 Warsaw,
  • Loyalty card or Card – a card issued to the bearer, entitling the holder to redeem it in a stationary store;
  • Holder – the purchaser or any other third party who holds the gift card,
  • Goods – items offered for sale in a stationary store.

1. General provisions 

1.1. These regulations define the rules for using the Card, granted to selected customers of the boutique at ul. Mokotowska 51/53 in Warsaw.

1.2. The Card is addressed to a closed group of recipients – selected persons (only adult natural persons), based on the individual decision of the Issuer, which is not subject to appeal. 

1.3. The Card is not publicly available to all customers and cannot be sold or transferred to third parties.

1.4. The Gift Card cannot be exchanged for cash.

1.5. The sale of the Card is prohibited.

1.6. The provisions of the Act of 19 August 2011 on payment services do not apply to the Card.

2. Terms of Use 

2.1. The Cardholder is entitled to a 30% (in words: thirty percent) discount on products from the regular collection available in the Boutique. 

2.2. In order to exercise the rights from the gift card, the holder is obliged, at the latest before finalizing the transaction of purchase of goods, to present the card to the staff of the stationary store. The above action of the holder also constitutes authorization for the Issuer to make the transaction on the terms specified in these regulations.

2.3. The discount does not apply to discounted items and cannot be combined with other promotions and special campaigns conducted by the Boutique. 

2.4. The Card is valid only in the Boutique at ul. Mokotowska 51/53 in Warsaw and does not entitle to discounts in online sales or in other locations.

2.5. Only the Issuer is entitled to issue the Card.

2.6. The Issuer has the right to refuse to reduce the price using the Card, in particular if the Card has expired.

3. Validity period and extension 

3.1. The Card is valid for a period of 5 years from the date of issue. 

3.2. After the period of validity has expired, the Issuer may, at its sole discretion, extend its validity for another period.

3.3. The Issuer may temporarily suspend the validity of Cards or cease issuing Cards by informing about this fact on its website or by informing authorized persons electronically.

4. Loss, destruction, unauthorized use of the Card

4.1. The Holder is solely responsible for the loss or destruction of the Loyalty Card.  A new card may be issued in place of a lost card only if the holder reports such a need to the Issuer and the holder's identity is confirmed by the Issuer.

4.2. The holder is obliged to make every effort to prevent use of the gift card by unauthorised persons.

5. Personal data

5.1. The controller of personal data is the company under the name of Vanda Novak spółka z ograniczoną odpowiedzialnością, entered into the Register of Entrepreneurs of the National Court Register under the KRS number 0000712700, NIP: 6751632399, REGON: 369217883 with its registered office in Kraków (31-511), ul. Rakowicka 11.

5.2. The Participant's personal data are processed for the purpose of: implementing the loyalty program, including granting and realizing benefits resulting from having a Loyalty Card (Article 6, paragraph 1, letter b of the GDPR), pursuing claims and defending against claims (Article 6, paragraph 1, letter f of the GDPR), fulfilling obligations arising from legal provisions (Article 6, paragraph 1, letter c of the GDPR).

5.3. Providing personal data is voluntary, but failure to provide it may prevent you from using the Card.

5.4. The Cardholder has the right to access their data, rectify it, delete it, limit its processing, transfer it, object, lodge a complaint with the supervisory authority (i.e. the President of the Personal Data Protection Office, address: ul. Stawki 2, 00-193 Warsaw ( www.uodo.gov.pl ) and withdraw consent at any time.

5.5. Personal data may be transferred to entities cooperating with the Administrator in the scope of handling the Loyalty Card, as well as to public administration entities, courts and judicial authorities in order to perform statutory obligations and to pursue claims.

5.6. The data will be stored for the period of validity of the Card or until the Participant withdraws consent, taking into account applicable law.

5.7. Data is not subject to profiling and is not transferred to third countries outside the EEA.

6. Complaints

6.1. If the program is conducted contrary to the Regulations, the client has the right to file a complaint. 

6.2. In order to streamline the process of reporting and considering, a complaint may be submitted in electronic form to the following address: shop@vandanovak.com or in writing to the following address: Vanda Novak sp. z oo, ul. Rakowicka 11,  31-511 Krakow.

6.3. The person filing a complaint should include his/her personal data in the content of the complaint,
so that contact with him in order to inform him about the outcome of the complaint procedure is possible . 

6.4. Complaints will be considered within 14 days from the date of receipt. 

7. Final provisions 

7.1. The Issuer reserves the right to change these regulations at any time, informing Card holders thereof. 

7.2. The Issuer has the right to withdraw the rights arising from the Card in the event of a breach of the regulations or detection of abuse. 

7.3. Any disputes concerning the application of these regulations will be settled amicably, and if this does not resolve the conflict, the court competent to settle the dispute will be the court competent for the Exhibitor's registered office.

7.4. Polish law shall apply to the legal relationship resulting from the issuance of the card.

7.5. These regulations are effective from the date of their publication (03/03/2025) and apply to all Loyalty Card holders.
